Nursing home failures allegedly led to death

There are many good care facilities in Chicago, Illinois. Some give their clients their money's worth and then some, following all laws, regulations and rules and giving their business a good name. Other care facilities, however, are staffed by people who by action or inaction are directly culpable for harm coming to the residents in their care, which constitutes nursing home abuse or neglect.

A recent wrongful death lawsuit alleges such a situation in a North Aurora nursing home. According to the lawsuit, the nursing home's failures directly led to a resident's death.

The resident had lived at the nursing home a for a year before the accident that claimed her life. The suit alleges that nursing home staff members should have known that she was at risk for falls and taken the necessary steps to protect her.

Instead, the resident suffered a severe fall in 2016, sustaining multiple injuries. Those injuries included orbital, nasal and cervical fractures, as well as a forehead laceration. The laceration, according to the complaint, needed 10 stitches.

Additionally, the complaint states, the fall caused the resident's physical and mental condition to deteriorate and led directly to her death. The complaint say that part of the problem leading up to the fall was the failure by nursing personnel to evaluate the resident in a way that would ensure she received the supervision and assistance that she needed to prevent her from falling.

It is also alleged that there was not a comprehensive assessment of the resident's needs and that there was not an appropriate care plan in place to prevent the resident from suffering falls. All of those failures lead to the fall that, according to the lawsuit, resulted in the resident's death.
