Nursing home patient dies, son files wrongful death lawsuit

The son of a woman who died at age 65 at Salem Village Nursing and Rehabilitation Center in Joliet has filed a wrongful death lawsuit over the staff's negligent treatment of his mother.

According to the complaint, the senior citizen was admitted on Feb. 25 of last year and died the following month.

Last month, her son filed his lawsuit that alleged staff members at the nursing center didn't follow the prescribing physician's orders regarding the administration of his mother's medicine to treat her diabetes. As a result of their negligence, she died.

His complaint reads, in part, "As a direct and proximate result of the death of (the woman), deceased, (plaintiff) has been deprived of society, companionship and affection and has suffered grief and sorrow and emotional distress." He seeks damages in excess of $50,000.

Also, plaintiff alleges that the staff at the nursing center did not follow their own policies in regard to the way medicine was administered, and that they did not train the employees adequately to administer medication to their patients.

Whether loved ones are admitted to nursing homes for extended stays or to recuperate for a week or two following an accident or illness, their relatives expect that standards of care will be met or exceeded. Because of the incapacity that frequently is present in nursing home patients, relatives and friends may be forced to advocate for them when they can no longer do so for themselves.

When the medical facility's employees' errors are so egregious that a patient dies, the only recourse available may be through the Illinois civil court system.
